Bill Collector Abuse! Bill collectors are being sued in courts across the country for allegedly violating the FDCPA (Fair Debt Collections Practices Act) by making harassing and abusive phone calls to consumers. There are all kinds of websites out there that list all of the so-called abuses of bill collectors but in most cases these websites are giving you bad information. We at DebtEliminationTools.com only give you accurate information based on our expert legal research department’s findings. We know what constitutes harassing or abusive language. How do we know? We constantly are reviewing Court cases across the country involving bill collector lawsuits and here is what we found the Courts to consider to be harassing or abusive. Section 1692d of the FDCPA provides that a bill collector may not engage in “any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt.” See 15 U.S.C. § 1692d. In addition, section 1692d(2) of the Act prohibits a bill collector from using “obscene or profane language or language the natural consequence of which is to abuse the hearer or reader.” But what exactly does this mean? In order to answer that question [...]

Facebook® Policy Says A Bill Collector Can Not Use It’s Site To Get People To Contact Them To Acknowledge A Debt A Florida bill collector recently contacted a St Petersburg woman’s Facebook® friends in an effort to get them to tell her to call the bill collector to acknowledge an alleged outstanding $362 car loan debt. The woman, Melanie Beacham, didn’t like the fact that the bill collector, MarkOne Financial, embarrassed her in front of her facebook friends so she sued the bill collector. According to the bill collector lawsuit filing, a MarkOne employee going by the name Jeff Happenstance contacted both the woman and two of her friends on her Facebook® page. As you can see in the message above, Happenstance asked the friends to have Beacham contact him without making reference to her debt. As we have previously pointed out in our article, “Social Networking Sites Are Bill Collectors #1 Tool”, bill collectors use facebook®, twitter® and Linkedln® as a tool to find people who owe money. Now we learn from reading about this lawsuit that bill collectors also use social networking sites to communicate with a debtor who they are unable to reach by telephone.
As I am sure you already know, a robo signer refers to a Bank employee whose job it is to sign their name to as many “false affidavits” as possible without reading them. Robo signed false affidavits have been a rage among mortgage servicers and debt collectors for the past decade or more. I Guess False Affidavits Are OK For Banks To Use! Instead of acknowledging that these robo signed false affidavits are to blame for the economic and legal disaster our country finds itself in, treasury secretary Timothy Geithner wants to punish the legal aid attorneys who discovered the crime by taking away their funding. That will teach them for making the public aware that Banks use false affidavits. Using False Affidavits Will Soon Be Government Policy He wants to allow the banks to continue to do business as usual and allow them to use false affidavits. Why would he do that? To answer that question take a look at who is a major major contributor to Democratic election fundraisers. Take a look at the industry that many of Obama’s hand picked political appointees came from. The mortgage, banking and financial services sector! Eliminating False Affidavits [...]

If you have ever had to endure a Civil Lawsuit then I am sure you can attest to the fact that consumers very seldom experience “Due Process” like a corporate litigant does. Well here’s an exception that everyone should applaud considering it pertains to “Foreclosures” and will hopefully also pertain to a Consumer getting due process in Consumer Debt related litigation as well. Due Process Ruling #1 In January 2011 the highest court in Massachusetts ruled that Wells Fargo and US Bank erred when they seized 2 troubled consumers homes without being able to produce a copy of the original note. This supreme court ruling puts the nation’s Banks on notice that the Courts will not grant a forclosure order if it is based on improper or incomplete paperwork. In other words, the “produce the note” due process strategy not only works, it is the law. At least in Massachusetts. Hopefully this supreme court decision will spill over into other states, since the foreclosure process in Massachusetts is similar to other states that permit non-judicial foreclosure. Besides, taking property without competent evidence kind of flies in the face of the Due Process Clause don’t you agree? Due Process X 2 The Massachusetts [...]

Finally there is some good news to report regarding the auto loan rate you can get in 2011. Things are starting to look up for consumers who want to finance their car purchases. Credit restrictions are easing for auto loans and auto loan rates have dropped considerably. Even people with imperfect credit scores can find financing for their car purchases, auto financing experts say. As always, however, your FICO Score will control the amount you can finance and the auto loan rate that you’ll pay. The average auto loan rate fell to just 4.16% in January, 2011. The best auto loan rate available to you is for a new vehicle purchase. In fact, many dealerships are offering a zero auto loan rate on an assortment of vehicles if your FICO score is 740 or higher. A 740 FICO Score Will Qualify You For An Auto Loan Rate of 0% Overall, it has been reported that 15.4% of auto loans — nearly 1 in 6 — charge no auto loan rate at all. That’s right, 0 (zero) interest. Zero interest auto loan rates only apply to new car purchases. The typical auto loan rate for a used car remains at 8% or higher. Auto loan rates have fallen across the board [...]

“Not Giving Deadbeats Due Process Is The Definition of Due Process Your Honor.” That’s the attitude that most Debt Collection Attorneys have when they are forced to have to follow the rules of civil procedure and the rules of evidence to prove that you owe the amount they claim you owe. The collection industry does not believe that people who allegedly owe money on a debt have the right to “due process”. It doesn’t matter to them that the Fifth Amendment to the U.S. Constitution provides that no person shall be “deprived of life, liberty, or property, without due process of law.” Collection attorneys believe they are above the law. It is obvious from the case described below that creditors and the debt collection industry alike feel that people who can’t pay their debts don’t have to be given their right to due process of the law, after all, they are deadbeats and shouldn’t have any rights to due process. Filing False Affidavits Is “DUE PROCESS” For These Deadbeats, Isn’t It? It shouldn’t matter that the defendant in this Nevada Court is an “Unlicensed Process Serving Company” allegedly signing false affidavits stating that they served all of the alleged deadbeat debtors. After all, in these hard economic times, the Courts should realize that “NOT” [...]

What Is “MERS” and What Role Does It Play in the Foreclosure Scandal ? The Mortgage Electronic Registration Systems Inc, better known as MERS is a “shell” corporation with no employees created and owned by all of the big banks and used to process title to property that the Banks write mortgages on. Approximately 60% of the nation’s residential mortgages are recorded in the name of MERS. How can a company that holds millions of mortgages have no employees? It has no employees but it has thousands of so-called officers who’s only duties consist of signing false affidavits and bogus mortgage documents. Even though they swear under oath to having personal knowledge of the accuracy of these documents they have no knowledge of anything. They simply sign documents they are told to sign. When any of the big banks or mortgage companies grant a mortgage to a home buyer they immediately assigned the mortgage to the shell corporation MERS. Their main reason for doing it this way is to avoid filing fees for recording documents at county registars as required by state law. In other words, MERS is an entity used by the Banks to aid and abet a felony. In the mid-1990s [...]
